Medical decision making on behalf of unrepresented patients is one of the most challenging ethical issues faced in clinical practice. The legal environment surrounding these patients is equally complex. This article describes the efforts of a small coalition of interested healthcare professionals to address the issue in Colorado. A brief history of the effort is presented, along with discussion of the legal, ethical, practical, and political dimensions that arose in Colorado’s effort to address decision making for unrepresented patients through an (...) extension of the existing Colorado Medical Treatment Decision Act (CRS 15-18). Risk management of nanotechnology is challenged by the enormous uncertainties about the risks, benefits, properties, and future direction of nanotechnology applications. Because of these uncertainties, traditional risk management principles such as acceptable risk, cost–benefit analysis, and feasibility are unworkable, as is the newest risk management principle, the precautionary principle. Yet, simply waiting for these uncertainties to be resolved before undertaking risk management efforts would not be prudent, in part because of the growing public concerns about nanotechnology driven by risk perception (...) heuristics such as affect and availability. A more reflexive, incremental, and cooperative risk management approach is required, which not only will help manage emerging risks from nanotechnology applications, but will also create a new risk management model for managing future emerging technologies. As policy makers struggle to develop regulatory oversight models for nanotechnologies, there are important lessons that can be drawn from previous attempts to govern other emerging technologies. Five such lessons are the following: public confidence and trust in a technology and its regulatory oversight is probably the most important factor for the commercial success of a technology; regulation should avoid discriminating against particular technologies unless there is a scientifically based rationale for the disparate treatment; regulatory systems need to be flexible (...) and adaptive to rapidly changing technologies; ethical and social concerns of the public about emerging technologies need to be expressly acknowledged and addressed in regulatory oversight; and international harmonization of regulation may be beneficial in a rapidly globalizing world. Nanotechnology is the latest in a growing list of emerging technologies that includes nuclear technologies, genetics, reproductive biology, biotechnology, information technology, robotics, communication technologies, surveillance technologies, synthetic biology, and neuroscience. As was the case for many of the technologies that came before, a key question facing nanotechnology is what type of regulatory oversight is appropriate for this emerging technology. As two of us wrote several years ago, the question facing nanotechnology is not whether it will be regulated, but when and (...) how.Yet, appropriate regulation of nanotechnology will be challenging. The term “nanotechnology” incorporates a broad, diverse range of materials, technologies, and products, with an even greater spectrum of potential risks and benefits. This technology slashes across the jurisdiction of many existing regulatory statutes and regulatory agencies, and does so across the globe. Nanotechnology is developing at an enormously rapid rate, perhaps surpassing the capability of any potential regulatory framework to keep pace. Finally, the risks of nanotechnology remain largely unknown, both because of the multitude of variations in the technology and because of the limited applicability of traditional toxicological approaches such as structure-activity relationship to nanotechnology products. Orthologic is defined by weakening the axioms and rules of inference of the classical propositional calculus. The resulting Lindenbaum-Tarski quotient algebra is an orthoimplication algebra which generalizes the author's implication algebra. The associated order structure is a semi-orthomodular lattice. The theory of orthomodular lattices is obtained by adjoining a falsity symbol to the underlying orthologic or a least element to the orthoimplication algebra.

In 2016, the Colorado legislature passed an amendment to Colorado’s medical proxy law that established a process for the appointment of a physician to act as proxy decision maker of last resort for an unrepresented patient (Colorado HB 16-1101: Medical Decisions For Unrepresented Patients). The legislative process brought together a diverse set of stakeholders, not all of whom supported the legislation. Following passage of the statutory amendment, the Colorado Collaborative for Unrepresented Patients (CCUP), a group of advocates responsible for initiating (...) the legislative process, coordinated a unique effort to engage these stakeholders in the creation of a set of voluntary guidelines to assist facilities and individual careproviders in the implementation of policies and procedures enabled by the statute. This article delineates the questions and concerns of stakeholders, describes how those issues were addressed within the guidelines, and proposes additional opportunities for research to assess the impact of the legislation in Colorado. New communication technologies such as the microcomputer, videotex/teletext systems, the videocassette recorder, and satellite receiving dishes have been available to farmers since the early 1980s. This longitudinal study examines ethical issues associated with the impact that differential patterns of adoption and use of these technologies have had on inequalities among farmers from 1982 to 1989. The results demonstrate a strong adoption and use bias toward larger scale farmers who already have well-developed skills for handling information. This bias is especially strong (...) for microcomputer and videotex/teletext systems, and it isincreasing over time. Although the same farmers are not adopting all communication innovations, there is a strong tendency toward the already information-rich making the most use of the innovations they adopt. The article concludes with several recommendations that would help minimize some of these information inequalities. (shrink)

“La Poésie Comme Exercice Spirituel” first appeared in a 1942 issue of Revue Fontaine edited by Jacques and Raissa Maritain and was subsequently republished in Wah’s 1948 text Poésie, Pensée, Perception, published by Calmann-Lévy. The following is a translation of the Fontaine version. I have noted all of the variations from the latter version in the notes. As I emphasize in my commentary, the piece is a notable display of Wahl’s eclectic range of influences. Most importantly, it shows the extent (...) to which his interest in radical empiricism and process metaphysics informs his creative approach to the intersection of poetics and metaphysics. These interests are not explicitly named in the essay, and yet their influence is pervasive. Background: Electroconvulsive therapy is one of the most effective treatments for major depressive disorder. Recently, there has been increasing attention to evaluate the effect of ECT on resting-state functional magnetic resonance imaging. This study aims to compare rs-fMRI of depressive disorder patients with healthy participants, investigate whether pre-ECT dynamic functional network connectivity network estimated from patients rs-fMRI is associated with an eventual ECT outcome, and explore the effect of ECT on brain network states.Method: Resting-state functional magnetic resonance imaging data were (...) collected from 119 patients with depression or depressive disorder, and 61 healthy participants, with an age mean of 52.25 years old. The pre-ECT and post-ECT Hamilton Depression Rating Scale were 25.59 ± 6.14 and 11.48 ± 9.07, respectively. Twenty-four independent components from default mode and cognitive control network were extracted, using group-independent component analysis from pre-ECT and post-ECT rs-fMRI. Then, the sliding window approach was used to estimate the pre-and post-ECT dFNC of each subject. Next, k-means clustering was separately applied to pre-ECT dFNC and post-ECT dFNC to assess three distinct states from each participant. We calculated the amount of time each subject spends in each state, which is called “occupancy rate” or OCR. Next, we compared OCR values between HC and DEP participants. We also calculated the partial correlation between pre-ECT OCRs and HDRS change while controlling for age, gender, and site. Finally, we evaluated the effectiveness of ECT by comparing pre- and post-ECT OCR of DEP and HC participants.Results: The main findings include depressive disorder patients had significantly lower OCR values than the HC group in state 2, where connectivity between cognitive control network and default mode network was relatively higher than other states, Pre-ECT OCR of state, with more negative connectivity between CCN and DMN components, is linked with the HDRS changes. This means that those DEP patients who spent less time in this state showed more HDRS change, and The post-ECT OCR analysis suggested that ECT increased the amount of time DEP patients spent in state 2.Conclusion: Our finding suggests that dynamic functional network connectivity features, estimated from CCN and DMN, show promise as a predictive biomarker of the ECT outcome of DEP patients. Also, this study identifies a possible underlying mechanism associated with the ECT effect on DEP patients. (shrink)

He was just right for his time, he was ahead of his time, and he may be just what Franciscans need today in their time as they continue to renew themselves in the spirit of St. Francis and in Franciscan Christology and spirituality.Abbott sets down her goal: "My purpose and goal in publishing this book is that something of the man and his vision will be communicated here, and that a new generation of Franciscan friars and scholars, as well as believers and unbelievers more widely, may be inspired by this vision and become aware of Doyle's enduring and precious legacy" (ii). She accomplishes her goal through an introduction, fifteen chapters which mainly delve into Doyle's Franciscan Christology and spirituality, and a conclusion. Endnotes follow each chapter. The book, which is very well-researched and written, ends with two appendices and a bibliography. His Franciscan spirituality permeated his total thinking" (174). I underscore Bishop Mc-Mahon's emphasis on St. Francis and his spirituality. I see implied here Doyle's teaching about the Absolute Primacy of Christ—that Christ is head of all creation and conqueror of sin and death, and that the reason for Christ's incarnation is not sin but love—demonstrating Doyle's retrieval of the best from the Franciscan tradition.The second snapshot points to two areas where Doyle was ahead of his time. First, he was a TV personality. Abbott dedicates pages 117–23 to Doyle as a wonderful TV presence. From 1971 to 1984 he was on four hundred programs of The Big Question. One reviewer noted: "The length, breadth and width of his discourse … is colossal … This man is an original, a non-pareil; before they made him, they broke the mould" (121). Second, in his book on Francis's Canticle of Brother Sun, first published in 1980, Doyle anticipated many of Pope Francis' teachings in Laudato Si'. As Abbott says: "Foreshadowing much of Pope Francis' encyclical Laudato Si', Doyle demonstrates how belief in the universal brotherhood and sisterhood of creation can help us create a better world" (270).The third snapshot is an indication of how Doyle's legacy continues in print. Although histories of cognitive behaviour therapy have begun to appear, their use with people with psychosis diagnoses has received relatively little attention. In this article, we elucidate the conditions of possibility for the emergence of cognitive behaviour therapy for psychosis (CBTp) in England between 1982 and 2002. We present an analysis of policy documents, research publications and books, participant observation, and interviews with a group of leading researchers and senior policy actors. Informed by Derksen and Beaulieu’s articulation of social technologies, (...) we show how CBTp was developed and stabilised through the work of a variety of overlapping informal, academic, clinical, professional, and policy networks. The profession of clinical psychology played a key role in this development, successfully challenging the traditional ‘division of labour’ where psychologists focused on ‘neurosis’ and left ‘psychosis’ to psychiatry. Following Abbott's systems approach to professions, we identify a number of historical factors that created a jurisdictional vulnerability for psychiatry while strengthening the jurisdictional legitimacy of clinical psychology in providing psychological therapies to service users with psychosis diagnoses. The National Institute for Health and Clinical Excellence played a significant role in adjudicating jurisdictional legitimacy, and its 2002 schizophrenia guidelines, recommending the use of psychological therapies, marked a radical departure from the psychiatric consensus. Our analysis may be of wider interest in its focus on social technologies in a context of jurisdictional contestation. We discuss the implications of our study for the field of mental health and for the relationship between clinical psychology and psychiatry. (shrink)

Progressive intellectuals at the turn of the last century founded the modern American university, created its disciplines and edited the journals that codified their thoughts. They created the ligaments of the national administrative and regulatory state; they helped legitimate the creation of a national financial and industrial corporate economy. Through the writings of Lyman Abbott, Albion Small, and Simon Patten, three features of progressive thought are underlined: the primacy of a narrative, their hostility to “principled” or abstract-philosophical forms of (...) political and social thought, and their confidence that historical modes of social inquiry would produce “laws”? of progress that would guide practice and anchor values integrating self and society on a democratic basis. Five topics contain these animating features: national patriotism, the new industrial economy, a new democratic ethic, social Christianity, and their critique of the dominance of constitutional jurisprudence and law in American political institutions and practices. This would have been a better book if Sampson had argued his main point, the usefulness of the Simonian principle as an explanation of the evolution, structure, and acquisition of language, on its own merits, instead of making it subsidiary to his attack on ‘limited-minders’ (e.g., Noam Chomsky). The energy he has spent on the attack he might then have been willing and able to employ in developing his argument at reasonable length and detail. He might then have found that (...) argument faulty, or even wrong. Underdeveloped as it is, however, his point about the Simonian principle does seem to have thepossibility of some significance in understanding the empirical issues of this book (and the dichotomy of ‘limited’ and ‘creative’ minds is certainly not one of these).What Sampson has done inMaking Sense has the appearance of science, and theoretical linguistics, and therefore it is somewhat puzzling to find the conclusions that the human mind cannot be scientifically studied (p. 10), and that theoretical linguistics is a “mirage” (p. 210). His statement that It may still seem worthwhile to some to work out the exact implications for present-day linguistic structure of the fact that languages are evolved systems, but I cannot see that there is much glamour or, indeed, much substance in this task (p. 210) would surely be surprising to a geneticist or ethologist. We hope his apparent misunderstanding on this point will not lead him to give up his profession, in which he seems willing and able to make a significant contribution.What in particular is required is a clear indication of how the Simonian principle imposes itself in the ontogenesis of language. Consider Chomsky's example of the rule for forming questions in English. For sentence (1) below, children able to deal with such examples would give (2) but not (3) as the corresponding question (Chomsky, 1975, p. 31).The man who is tall is in the room.Is the man who is tall in the room?*Is the man who tall is in the room?Now compare Sampson's evolutionary explanation for the structure-dependence of rules which is illustrated in (1)-(3): “once a behavior-pattern has become thoroughly established, it will tend to be treated as a fixed given when used as a constituent of a more complex, later-learned behavior-pattern” (p. 183). In order for this to account for Chomsky's example it would have to be the case that children learn relative clauses before they learn questions, which simply isn't true.In conclusion, we wish not to seem unaware of the problems with the position Sampson is attacking, or unaware of the sometimes dogmatic way it too has been presented. Chomsky's hypothesis of innate linguistic ideas seems, fundamentally, to derive from the claimed rapidity and uniformity of language acquisition in the face of limited and degenerate data. Chomsky appears to have been unwilling to argue these points directly or to show their relation to others, for which he has argued, for example, the implausibility of some abstract constraint's having been learned (cf. 1971, pp. 22–44; 1975, pp. 30–33; 1980, pp. 35–52). And almost from his first invoking of rationalism in support of his linguistic method, Chomsky has himself resorted to an unnecessarily polemical attack on empiricism (cf. 1965, p. 58, n. 33). The innateness issue is just not clear or simple enough to justify so much animus, or even conviction. (shrink)

Why are bookstore shelves filled with mysteries, horror stories, romances, Westerns and other genre fiction? Why should one spend time reading narratives that are so similar? Why, for that matter, should one write works that are so similar to those of other authors? One philosopher, Noel Carroll, in fact, refers to the phenomenon as the ?paradox of junk fiction?. Are there works in political theory as well that share characteristics with these genres? And is there also a paradox involved among (...) both these readers and authors? This essay reviews both the criticisms and defenses of popular generic texts focusing on arguments that defend the complexity of genre texts and those that deny the distinction between generic works and others. Utopias are identified as counterparts in political theory and are applied to this genre debate. I conclude by revising the genre paradox. (shrink)
